The American Chamber of Commerce asks ERO to repeal the decision on the “open energy market”, after the Commercial Court issued a verdict

The American Chamber of Commerce has called on ERO to immediately repeal the decision to liberalize the energy market.

This is after the Commercial Court ruled to suspend the “open energy market”.

Following today’s verdict of the Department for Administrative Matters of the Commercial Court, which approved in full the lawsuit against the Energy Regulatory Office (ERO), annulled the latter’s response as unlawful, and ordered ERO to reassess the decision to liberalize the energy market within 30 days, the American Chamber of Commerce in Kosovo reiterated its call to ERO to immediately repeal this contested decision.

“The Commercial Court’s judgment not only suspends the execution of the notice on the liberalization of the energy market until a new decision on the appeal, but also highlights serious shortcomings in the actions taken by the regulator. This development supports the position of the business community and the American Chamber of Commerce on the necessity of respecting the standards of legal certainty and the involvement of all interested parties in such important processes for the country’s economy. The uncertainty created by this process has deeply affected the operation of businesses, affecting their strategic planning and undermining trust in the regulatory system.”

“Reforms in critical sectors such as energy must be built on the principles of transparency, inclusive dialogue, and equal treatment. The American Chamber of Commerce calls for an immediate resumption of structured dialogue between the Government of Kosovo, ERO, and the business community, so that any future steps are in line with applicable laws, international best practices, and the real needs of the economy,” the American Chamber of Commerce said in a statement.
